Mac OS X software updates for May 2
Here are the latest incremental updates for Mac OS X apps. Oranged Software (http://www.oranged.ne) has released Studiometry 9.2, an update to its software solution for small businesses that organizes, plans, tracks, and invoices clients and projects. Version 9.2 has over 40 new features, tweaks, and improvements. Coding Turtle has announced Scrambler 1.1 (http://codingturtle.com/scrambler), an update to their encryption app for Mac OS X. With version 1.1, there's no limit on how large files can be encrypted. There's a new progress indicator displaying the percentage completion of the encryption or decryption process and the ability to cancel encryption or decryption before completion. Nineteen million American mobile gamers play on an iPhone
Of all American mobile gamers, 19 million play on an iPhone, which is 28% of all smartphone gamers, according to new data from NewZoo (http://www.newzoo.com), an international market research firm focused purely on the games industry. An additional 18 million plays games on an iPod touch. In the tablet gaming space, the iPad is dominant with a share of 60%, or 12.7 million Americans. NewZoo says Apple’s position is strongest when it comes to revenues. In March, all iOS devices combined earned 84% of mobile revenues generated by the top 200 grossing games in the three stores combined: iPad, iPhone/iPod App Store and Google PlayStore. Apple planning to become a direct mobile service provider?
Apple plans to take on carriers like AT&T and Verizon Wireless by becoming a direct mobile service provider, according to eteran wireless industry strategist Whitey Bluestein, Bluestein -- who has managed strategic deals for the likes of AT&T, Intel, T-Mobile, Verizon, Microsoft, Nokia and Best Buy -- tells "BGR" (http://macte.ch/4S5Bv) that Apple will soon begin to offer wireless service directly to iPhone and iPad users. Apple wants to bar Jobs' deposition in Eminem lawsuit
In an ongoing lawsuit, Apple claims a deposition of Steve Jobs from a 2010 trial involving F.B.T. Productions, producers of Eminem tracks, could, if released, bring competitive harm to the company over “highly confidential and proprietary trade secrets," reports "TechCrunch" (http://macte.ch/a7C5C). The lawsuit was filed in a Los Angeles court over three years ago by the rapper's production company F.B.T. The issue: whether musicians should be entitled to a larger share of digital download revenues given that much of the overhead in promoting and distributing songs online falls on service providers like Apple, not the labels. F.B.T. claims that UMI owes Eminem more money for the music it sells via third-party distributors like iTunes or phone companies who offer musical ringtones. The production company argued that all UMG is providing to the online retailer is a digital file -- with no costs incurred from things like jewel cases, liner notes, sales teams or in-store displays....

Forstall, Drexler sell some Apple shares
According to filings with the Securities and Exchange Commission -- as noted by "Barron's" (http://macte.ch/JH3Hj) -- Scott J. Forstall (pictured), Apple's senior vice president of iPhone software, sold 64,151 Apple shares for US$38.7 million. The sale represented a 95.5% stake of Forstall’s direct holdings, leaving him with 2,988 shares left following the transaction. According to "Barron's," this is Forstall's first major sale since he sold over 40,000 shares in April 2010. Also, Apple board of director member, Millard Drexler, has exercised and sold 40,000 shares for an average of $603.52 a share, netting $23.7 million.

OS X Flashback malware could generate $10,000 daily for hackers
The Flashback malware that's infected hundreds of thousands of Macs may be generating more than US$10,000 a day for the hackers who made the Trojan horse, according to the security specialist company, Symantec. The malware steals clicks from ads that Google's search engine displays alongside search results. In a blog post (http://macte.ch/o7vTh) Symantec said that botnet measuring in the region of 25,000 infections could generate the author up to $450 per day. Considering the Flashback Trojan measures in the hundreds of thousands, this figure could sharply rise to the order of $10,000 per day. The Flashback ad-clicking component is loaded into Chrome, Firefox, and Safari where it can intercept all GET and POST requests from the browser. Flashback specifically targets search queries made on Google and, depending on the search query, may redirect users to another page of the attacker's choosing, where they receive revenue from the click . (Google never receives the intended ad click.)

Judge warns Apple's lawyers against 'frivolous'...
Judge Richard A. Posner, who's presiding over the "Apple v. Motorola" patent lawsuit, has warned Apple lawyers against "frivolous" filings, reports "FOSS Patents" (http://macte.ch/2V8PZ). "I deny the second half of Apple’s motion (seeking prohibition of the deposition) as frivolous and the first half (seeking substitution) as untimely," he has ruled. "I've had my fill of frivolous filings by Apple. The next such motion, and I shall forbid it to file any motions without first moving for leave to file." Writing for "FOSS Patents," Florian Mueller says that Apple brought a motion to prevent Motorola from deposing a particular expert. Apparently the judge denied a similar with respect to the same expert only a few days before.

NetMarketShare: Mac OS X, Safari down, iOS up in April
According to the latest market share survey from NetMarketShare (http://www.netmarketshare.com), the market share for Mac OS X, Safari and iOS all dipped slightly month. According to the report, among desktop operating systems, Mac OS X had 6.53% of the global market share in April compared to 6.54% in March (that's global market share; in the US it's over 10%). Windows remains dominant with 92.49% as of April. That's up from 91.48% in March. When it comes to browsers, Safari had 4.81% in April compared to 5.07% in March. Internet Explorer had 53.09%, Firefox had 20.20% and Chrome had 18.85%. That compares to, respectively, March percentages of 53.83%, 20.55%, and 18.57%, respectively, for the browsers. The iOS's still dominated in April, according to NetMarketShare. It had 61.19%, compared to 18.66% for Android, 11.83% for Java ME, 2.24% for Symbian and 2.04% for Blackberry. Taiwanese carriers to offer iPad for the first time
Far EasTone Telecommunications and Taiwan Mobile say that consumers can begin to register for the new iPad. It's the first time that Taiwanese carriers will sell any version of the Apple tablet, reports "Focus Taiwan" (http://macte.ch/J5MgV). Far EasTone, Taiwan's number three telecom operator, said it began taking pre-orders for the 4G-equipped version of the new iPad through online registrations as well as at over 500 retail and franchise stores. The company will unveil an official sales date and related data plans soon, spokeswoman Alison Kao told "Focus Taiwan." Taiwan Mobile, the country's second largest carrier, also began taking pre-orders Tuesday on its official website and at its 350 stores, according to an e-mail sent to the media. However, it didn't say when the product would go on sale or offer details about its data plans. Taiwan's top carrier, Chunghwa Telecom, told "Focus Taiwan" that it currently has no plans to sell the new iPad.

Apple not among 'happiest companies for young professionals...
A new study by CareerBliss (http://www.careeerbliss.com) -- an online career community that provides company reviews by real employees, detailed salary information and local job opportunities -- says that Apple didn't make the list of its "happiest companies for young professionals." The top 10 companies on the list are GE Energy, Nordstrom, Fluor, United Space Alliance, AstraZeneca, Centex, GlaxSmithKline, Wipro, FedEx Express and Kaiser Permanente.. Travis commissions could vote on Apple deal today
A revised version of Travis County's [Texas] proposed incentive package to Apple sets an US$35,000 minimum salary for the lowest-paid of Apple's new Austin workers as part of a deal to bring 3,665 jobs to a planned North Austin campus, reports the "American-Statesman" (http://macte.ch/hgZhL). The change is among "a few substantive tweaks and other more superficial changes" made to the county's 15-year, $5.4 million to $6.4 million tax rebate offer, the article adds. The county would require an average salary of $35,000 for the bottom 10% of Apple-employed workers and $11 per hour for contractors, who will account for up to 25% of their new workers. U.K. ASA widens inquiry into Apple's 4G iPad claims
The U.K. Advertising Standards Authority (ASA) has widened its inquiry into Apple's advertising of the new iPad and taken issue with Apple's advertising of the new iPad as a "4G" device, even though it's not compatible with long-term evolution networks in the country, reports "BBC News" (http://macte.ch/jGg3D). The UK doesn't have widespread 4G coverage yet, and the iPad will be incompatible with it when it does, the article adds. The ASA says it's received "dozens" of complaints on the issue. The ASA told the BBC that when it approached Apple the company said it had removed references to 4G from the webpage subject to the complaint, and had edited a video that contained references to 4G. However, Apple's UK site still offers consumers the chance to buy a "wi-fi + 4G" version of the iPad. A footnote explains that "4G LTE" is supported only on certain networks in the United States and Canada.

Apple sells over 35 million iPhones in first quarter
The worldwide mobile phone market declined 1.5% year-over-year in the first quarter of 2012 (1Q12), as Samsung ousted longtime leader Nokia to become the world's top mobile phone vendor, according to new data from the IDC research group (http://www.idc.com). Though Apple slipped to second place among smartphones, it posted strong year-over-year growth.

 In fact, the Apple smartphone saw 35.1 million units shipped during Q112. Apple's gains in the market benefited from iPhone availability at additional mobile operators worldwide, as well as sustained end-user demand among both consumers and enterprise users, notes IDC. Samsung top smartphone brand, but Apple makes more money
New data from the Juniper Research mobile analyst firm (http://www.juniperresearch.com) shows Samsung and Apple trading places once again in the smartphone market, in what is increasingly becoming a two-horse race. In the first quarter of 2012, the company estimates that nearly 60% of the 139 million smartphones shipped worldwide carried either the Apple (35.1 million) or Samsung (46.9 million) brand -- up from 46% in the last three months of 2011. While Apple and Samsung have taken it in turns to lead the smartphone market over the last four quarters, it seems as if Samsung may now have established a firm lead in this space, shipping 11.8 million more units that the Cupertino, California company in quarter one, according to Juniper Research. Apple urges developers to apply for Gatekeeper Developer ID
As noted by "AppleInsider" (http://www.appleinsider.com) Apple has sent out a mass email to Mac developers urging them to apply for a Developer ID in preparation for the new operating system's Gatekeeper security system. The email says that while the Mac App Store is the safest place for users to download software for their computers, the company is concerned about protection from possibly malicious applications obtained through unmonitored channels, the article adds. San Diego school district going with iPads
After putting more than 75,600 netbooks into the hands of students, the San Diego Unified School District has switched its focus to iPads and will buy devices to outfit 340 classrooms before the end of the school year reports "U-T San Diego" (http://macte.ch/44yhQ). The district plans to purchase approximately 25,700 iPad 2s at a slight discount from retail to roll out to its fifth- and eighth-grade classes as well as some high school classes by next fall, the article adds. Australian Parliament investigating Apple, others for '...
Apple and Microsoft will be among technology companies asked to explain to the Australian Parliament why Australians pay much more for music and game downloads from iTunes, for example, than overseas customers, reports the "Sydney Morning Herald" (http://macte.ch/Lk5L8). Apple plans for Israeli R&D center kick into high gear
Preparations for Apple's Israeli research and development center have kicked into "high gear" with the company launching a major hiring campaign in the next few weeks, reports "YNet News" (http://macte.ch/1L51L). Apple's new hires will be located in Haifa's Scientific Industries Center, an international technology center known as Matam. The Haifa R&D center will be headed by Aharon Aharon, who will be joined by Etai Zaltsman, the former Deputy CEO of Texas Instruments in Israel. According to reports, Anobit founder Udi Weinstein is expected to leave, reports "YNet News." In December Apple bought Israel's Anobit, a maker of flash storage technology, for as much as US$500 million. 'Woz' to speak at EuraMedia Summit
Apple co-founder and chief scientist at Fusion-io, Steve "Woz" Wozniak, will speak at the 2012 EuraMedia Summit (http://euramediasummit2012.eventbrite.com/), which will be held in Boston, Massachusetts, June 13-16. EuraMedia was created "as a reaction to the enormous peak in recent interest in Russian media and tech markets by investors and entrepreneurs in both countries." No surprise, but Apple to remain top tablet vendor in second...
Global tablet shipments are expected to grow 47.5% on year to 21.58 million units in the second quarter of 2012; however, compared to the first quarter, shipments will drop 8.2%, according to Digitimes Research (http://www.digitimes.com) senior analyst James Wong, who added that Taiwan's shipments will account for 88% of global shipments and reach 18.9 million units, down 2.74 million units from the first quarter. As for rankings, according to the DigiTimes Research, Apple will remain as the leading tablet vendor in the second quarter, while Lenovo will drop out of the top five. Asustek Computer will have a chance to become a top three vendor, benefiting from its cooperation with Google for 7-inch products. As in terms of processors, Apple's processors will account for 70% of the total tablet shipments, while Nvidia will need to rely on Amazon's new 8.9-inch tablet PC to compete against Texas Instruments for market share in the second quarter. Analyst: Apple will 25 million iPhones in China this year
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Deutsche Bank analyst Chris Whitmore says Apple has "enormous" potential to grow its sales in China. In fact, he predicts Apple will sell 25 million iPhones in the country this year, and sales will grow to at least 35 million in 2013. Whitmore thinks China Telecom and China Unicom -- Apple's two carrier partners in China -- to approach 300 million 3G subscribers by the end of 2013. If Apple adds China Mobile as a partner, the iPhone maker's addressable market in China would increase by about 125 million 3G subscribers in 2013, bringing the total number of potential customers to nearly 425 million, according to Whitmore.

Barnes & Noble, Microsoft team up for ebook venture
Barnes & Noble (http://www.bn.com) and Microsoft (http://www.microsoft.com) has formed a strategic partnership in a new Barnes & Noble subsidiary. The new subsidiary, dubbed "Newco" for now, will bring together the digital and college businesses of Barnes & Noble. Microsoft will make a US$300 million investment in Newco at a post-money valuation of $1.7 billion in exchange for an approximately 17.6% equity stake. Barnes & Noble will own approximately 82.4% of the new subsidiary, which will have an ongoing relationship with the company’s retail stores. Barnes & Noble hasn't decided on the name of Newco. The company says one of the first benefits for customers will be a NOOK application for Windows 8, which will extend the reach of Barnes & Noble’s digital bookstore by providing one of the world’s largest digital catalogues of e-Books, magazines and newspapers to hundreds of millions of Windows customers in the U.S. and internationally.

ABI Research (http://www.abiresearch.com) has determined that the cellular handset market shipped 353.5 million handsets in the first quarter of 2012 (Q1 2012), which represents a -3.8% year-over-year and -16.5% sequential drop in shipments. The smartphone market delivered 142 million shipments in Q1 for a 38% year-over-year gain and a -8.1% sequential decline. Apple’s 35.1 million shipments were supported by APAC -- the part of the world in or near the Western Pacific Ocean, including at least much of East Asia, Southeast Asia, and Oceania -- while Samsung’s 83.4 million displaced Nokia from the top position that it has held for over a decade. Study says Apple customer service complaints low but ....
A new cross-industry study published by research firm Vocalabs (http://www.vocallabs.com) -- as noted by "AppleInsider" (http://www.appleinsider.com) notes that while Apple received fewer customer complaints than tech rivals Dell and HP, the company's automated call answering service is the weakest link in the chain. Vocalabs released its Special Cross-Industry Report focusing on customer service complaints as part of the company's ongoing National Customer Service Survey and found that Apple led the pack in most categories with extraordinarily low numbers. The study extrapolated data collected from 2,379 customer comments and complaints taken at the end of 7,149 phone interviews conducted between January 2011 to March 2012.

Apple purportedly working to stream EPIX films
Apple is working to stream films owned by EPIX, which is backed by three major movie studios, on devices including the current Apple TV and the rumored "iTV" (the rumored Apple HDTV), reports "Reuters" (http://macte.ch/Bgw9Q). Quoting two unnamed "people with knowledge of the negotiations, the article says it talking with three-year-old EPIX, which was created by Lions Gate Entertainment Corp, MGM and Viacom's Paramount Pictures. "Reuters" says "Apple is widely expected to unveil a full-fledged TV product later this year or in early 2013 to drive its next phase of growth and potentially revolutionize the industry."

Mac OS X software updates for April 30
Here are the latest incremental updates for Mac OS X apps. MaBaSoft (http://www.mabasoft.net/) has updated World Clock Deluxe to version 4.8. The app lets you display multiple clocks in a configurable horizontal or vertical palette, in the menu bar, and in the Dock, show Coordinated Universal Time and Internet Time, assign labels and colors to clocks, calculate date and time conversions across different time zones, and show the current weather all over the world. In version 4.8, 73 cities belonging to 36 different countries have been added to the World Clock Deluxe database, which now contains over 1,500 cities. Neatberry (http://neatberry.com) has announced Fumy 2.2 for Mac OS X. Fumy is a bitmap editor focused on special effects; version 2.2 adds a Lightning tool.

Analyst: iTV will sell even faster than the iPad
Eric Jackson, the founder and managing member of Ironfire Capital (a long/short and corporate governance-focused investment firm) thinks the rumored Apple-branded HDTV (the so-called "iTV") will sell even faster than the iPad, reports" Forbes" (http://macte.ch/x4CmF). "We live in this kind of sped up world," Jackson says. "The user base is there for Apple. When new, complementary devices get introduced by the company, the pickup is so quick. I think iTV is going to be even faster than the iPad. It’s gonna be, potentially, a pretty phenomenal product launch next year." Apple chomps Android out of Chomp app search engine
Apple has disabled the functionality of the Chomp app search engine for the Android platform after purchasing Chomp earlier this year, reports "AppleInsider" (http://www.appleinsider.com). "AppleInsider first began to receive word from readers on Thursday that Chomp was no longer working on Android phones," the article adds. "And as of Friday, the site no longer allows users to search for Android applications, only offering the iPhone and iPad as options." Chomp's proprietary algorithm learns the functions and topics of apps, so you can search based on what apps do, not just what they’re called. You can try searching for "puzzle games," "kids games," "expense trackers," "tip calculators" or "chat" to start finding the type of apps you're looking for. Chomp for iPhone was launched January 2010. It's a free download in the Apple App Store. Chomp for Android was launched in February 2011 and WAS a free download on the Android Market.

So what do consumers think of the new iPhone ads?
Ace Metrix (http://www.acemetrix.com), which specializes in analytics for television and video advertisers, says Apple’s new ads for iPhone starring Zooey Deschanel and Samuel L. Jackson were the most effective TV ads to break the week ending April 20, trumping two new Samsung Galaxy Note ads introduced the same week. The ads, which achieved Ace Scores of 653 and 645, respectively, are Apple’s most effective iPhone ads so far this year, but are still out-scored by Samsung’s “The Best of Phone and Tablet” Galaxy Note ad, which broke on Feb. 22 with an Ace Score of 686 and became the Ace Metrix "Q1 Ad of the Quarter." Apple, Samsung capture 55% of global smartphone shipments
According to the latest research from Strategy Analytics (http://www.strategyanalytics.com), global smartphone shipments grew 41% annually to reach 145 million units in the first quarter of 2012. Samsung and Apple together captured more than half of global smartphone shipments for the first time ever. "Samsung overtook Apple to become the world’s largest smartphone vendor by volume with a record 31% market share," says Alex Spektor, associate director at Strategy Analytics. " Samsung’s global smartphone shipments rose 253% annually to 44.5 million units, as demand surged for its popular Galaxy models such as the Note, S2 and Y." Apple's Austin expansion plans hit a snag
Apple's plan to expand its Austin, Texas, operation is endangered after an attorney calls a contract with Apple "rigged," reports "CNET." Last month the "Phoenix Business Journal" (http://macte.ch/nPz1m) reported that the Austin City Council was expected to approve an US$8.6 million incentive package for Apple as part of a larger $33.5 million incentive and tax break package to bring a $304 million company expansion to Texas, reports the "Phoenix Business Journal" (http://macte.ch/nPz1m). Now, speaking to the Austin-based "Statesman" newspaper, Dave Porter, senior vice president for economic development at the Greater Austin Chamber of Commerce, said that the deal between the city and Apple is not done, and "remains in peril." Apple sued over iPad Smart Cover
Another day, another lawsuit. "PaidContent" (http://macte.ch/I0DtB) reports that Aspen, Colorado resident Jerald Bovino has filed a federal lawsuit against Apple, claiming the company's Smart Cover for the iPad violates his 2005 patent for a portable computer case. The US$39.95 iPad Smart Cover snaps onto the Apple tablet via a magnetic hinge. It protects the iPad screen and folds into a typing stand. Close it, and iPad automatically goes to sleep. Open it, and iPad instantly wakes up — no need to press any buttons. Bovino's claim is based on US patent 6,977,809 which describes an "integral case" that attaches to a computer. The patent says the invention is useful for situations like airport X-ray lines, notes "paidContent."

Foxconn workers in China protest over wages
Workers at Foxconn Technology in China -- which makes iPhones and iPads among other products -- threatened to jump off the roof of a building in a protest over wages just a month after Apple and Foxconn announced an agreement on improving working conditions, reports "Reuters" (http://macte.ch/SPdsq). The protest happened in the central city of Wuhan at one of Foxconn's plants. It involved some 200 workers, the Hong-Kong based activist group Information Centre for Human Rights told "Reuters." A spokesman for Hon Hai Precision Industry, the listed unit of the Foxconn group, said the protest concerned workplace adjustments and involved workers new to the plant. He said it was not a strike. "The dispute has already been settled after some negotiations involving the human resources and legal departments as well as the local government," the Taipei-based spokesman, Simon Tsing, told "Reuters."

Oracle releases Java SE 7 Update 4, JavaFX 2.1
Oracle (http://www.oracle.com) has announced the availability of Java Platform, Standard Edition 7 Update 4 (Java SE 7 Update 4) and JavaFX 2.1. This release marks Oracle’s first delivery of both the Java Development Kit (JDK) and JavaFX Software Development Kit (SDK) for Mac OS X. Java developers can now download Oracle’s JDK, which includes the JavaF X SDK, for Mac OS X from the Oracle Technology Network (OTN). Oracle plans to release a consumer version of Java SE 7, including the Java Runtime Environment (JRE) for Mac OS X later in 2012.

Over 80% of top apps are localized in Japan, Germany, France
Locally developed and well-translated content is the key to having mobile apps discovered by consumers, according to new data from the ABI Research Group (http://www.abirsearch.com). In Apple’s Japanese App Store, 87% of the ten highest-ranked apps in all 21 categories were available in Japanese, as of February. Germany (83%) and France (82%) were other markets where over four-fifths of the highest-ranking apps were available in the local languages. In China, Chinese-speaking apps accounted for 76% of the highest-ranked apps -- with about half of them developed specifically for the local market.
