Android is turning out to be, as Steve Jobs likes to put it, “a bag of hurt,” Not only are all the Android handset makers fighting Apple in courts and import agencies around the world, Oracle has Google over the barrel for intentionally using patented Java without a license. The intentional part will likely cost Google a bundle as Oracle has found a “smoking gun” set of email proving that Google, at the highest levels, knew and intentionally used Java in the Android OS without a license.

When Google moved to buy Motorola they proclaimed that the purchase was to counter Apple and boost the patent portfolio behind the Android OS. They also maintained their intention to keep Android OS open source and support the various handset makers that have built the hardware behind the success of Android.

The tech industry is collectively scratching its head trying to figure out just what the Google purchase of Motorola Mobility will mean. The other Android handset makers are now worried Google will favor Motorola with advanced features and that they will be left out of the loop. Uncertainty in business is a powerful thing.

The patent war against Android has taken an interesting turn. Motorola Mobility has declined in market cap valuation to the point Google snapped it up in an acquisition described by both sides as amicable. According to the “Wall Street Journal,” the oldest of the handset companies, with a deep patent portfolio, sold for US$12.5 billion. Google intends to allow Motorola to continue business but with the Motorola patents in house, Google hopes to hold off Apple.

Apple is certainly on a roll. As the stock market has gyrated the last few days due to the downgrade of US Treasury debt, Apple replaced Mobile/Exon as the most valuable company in the world by market cap. Over the last week or so, Apple got Samsung’s new touch screen tablet banned in Australia and Europe. HTC took a hit in the US International Trade Commission and may also face import bans on its Android handsets in the US market.

Rumors of a second, smaller, cheaper iPhone have been making the rounds for a while now. There are some rumors the cheaper iPhone might be the older 3Gs. There are compelling reasons for Apple to add another cheaper model of the hot selling iPhone to their product line. Those reasons are market share and Android specifically. See:

Google to protect Android Handset Makers?

In the wake of the US International Trade Commission ruling that Android handset maker HTC has infringed on Apple patents, a number of interesting things have happened. First, the stock of HTC has taken a beating. The market is keen on the possibility that HTC and the Android OS may be in trouble. HTC has tried to shore up its stock valuation by buying up their own stock.

The recent US International Trade Commission finding isn’t the end of the war between Apple’s iOS platform and the Android platform, but drawing first blood may be significant. Had the ruling been related to something trivial like the shape of buttons, for example, HTC could have simply gone to round buttons instead of square buttons.

Cannacord Genuity analyst Mike Walkley has noted that a high percentage of Android smartphone users abandon their chosen platform when they buy an iPad instead of any other tablet. Walkley anticipates that Apple will have roughly 250 million iOS users by the end of the year. He also figures that there is about an annual 40% “replacement rate” on existing iOS users buying another newer iPhone or iPad.

When the Motorola/Apple cell phone came out in the summer of 2005, it was a great disappointment to both Apple and Apple fans. You might as well have taped an iPod to a standard cell phone. It sucked. Apple, by that point in time, already knew to do a cell phone right, they would have to start from scratch. The first thing they did was junk their cell phone engineering relationship with Motorola and also scrap conventional notions of what a cell phone was.
