HTC withdraws appeal against ITC dismissal of its Apple complaint

“FOSS Patents (http://macte.ch/OpN3B) reports that HTC has withdrawn its Federal Circuit appeal against the ITC (International Trade Commission) dismissal of its complaint against Apple.

Four months ago, the ITC dismissed a complaint HTC had brought against Apple in May 2010. The original complaint related to five patents. HTC withdrew one, and the ITC didn’t hold Apple to infringe any of the asserted claims from the four remaining ones. HTC almost immediately appealed the ITC ruling to the Court of Appeals for the Federal Circuit (CAFC), but it apparently concluded that this wasn’t worth pursuing, notes “FOSS Patents.”

In 2010 Apple filed a lawsuit against HTC for infringing on 20 Apple patents related to the iPhone’s user interface, underlying architecture and hardware. The lawsuit was filed concurrently with the U.S. International Trade Commission (ITC) and in U.S. District Court in Delaware.
