Judge says Samsung didn't willfully violate Apple patents
Judge Lucy Koh, the federal judge presiding over two Apple v. Samsung lawsuits in the Northern District of California, has entered four more post-trial orders. The biggest news is that, unlike the fury, she found that Samsung's infringement of Apple's patents wasn't willful.
As reported by "FOSS Patents" (http://www.fosspatents.com) the judge:
° Reversed the finding that Samsung's acts of patent infringement were willful (because Samsung had reasons to believe that what it was doing was legal) and overruled the jury with respect to a patent exhaustion question (which has no effect because the related patent was not deemed infringed by Apple), but otherwise upheld the jury's liability findings against Samsung, denying further modifications as well as a new trial;
° Denied Apple any damages enhancements for willful infringement (which could have resulted in a tripling of parts of the award); she also denied enhancements of trade dress damages on other grounds;
° Declined to overrule the...
Judge says Apple patents not invalid due to 'indefiniteness...
U.S. District Court Judge Lucy Koh has ruled that neither an Apple utility patent nor four design patents are invalid due to indefiniteness, reports "AppleInsider" (www.appleinsider.com).
The issue of indefiniteness was first entered during the Apple v. Samsung trial over Apple's U.S. Patent No. 7,864,163, otherwise known as the "tap to zoom" patent, when Samsung took issue with the term “substantially centered.”
In the patent language, Apple refers to graphical assets being "substantially centered" on a portable device's display. Samsung argued that the term was indefinite and thus the patent should be invalidated, notes "AppleInsider." Koh disagreed and denied the invalidation by citing a number of federal court cases that set precedent pertaining to the term "substantially."
This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-...

UK Internet users sue Google over privacy violations
Google is facing a legal battle from UK Internet users complaining that their privacy has been breached by the company, reports "Business Insider" (http://tinyurl.com/b6we543).
Twelve people are seeking damages from Google, claiming that their browsing habits were secretly tracked. It is thought the case, being brought against Google by law firm Olswang on behalf of the Internet users, is the first of its kind in the UK, notes "Business Insider."
The lawsuit says that cookies -- small tracking files -- were installed by Google on the Apple computers and mobile devices of those using the Safari internet browser without their knowledge. The 12 claimants puprotedly thought that cookies would be blocked because of assurances given by Google in the time their devices were allegedly affected, from summer 2011 to spring 2012, and also because of Safari's default settings, adds "Business Insider."
More British retailers recommend Samsung models over the iPhone
Samsung is recommended more often by British retailers than Apple, with BlackBerry and LG having almost no presence, according to new research by Informa Telecoms and Media -- as reported by "The Telegraph" (http://tinyurl.com/aze7jmh).
The article says the researchers visited John Lewis, Everything Everywhere, O2, 3, Maplins, PC World, Carphone Warehouse and Phones 4U. The mystery shoppers scored manufacturers based on whether they were advertised in the store window or in-store, then asked a sales assistant to recommend three smartphones or tablets. While some retailers recommended Apple's iPhone 5, rival manufacturers such as ZTE, Motorola, LG, Huawei and BlackBerry-maker RIM had little or no presence.
"he mystery shop showed that the most recommended Samsung handsets were the Galaxy SIII and the Galaxy Note II, despite having been on the market longer than the latest handsets from Apple, Nokia and HTC," says Julian Jest of Informa.
