Analyst: Apple has 80% of mobile profits
In a note to clients -- as reported by "Barron's" (http://macte.ch/qVPgC) -- Morgan Keegan analyst Tavis McCourt, says that, after looking at data from all makers of phones who have reported for the quarter so far, "Apple simply dominated Q4:11 handset/mobile computing trends."
He adds that Apple now accounts for nearly 50% of the revenues of the entire industry and over 80% of the profits by his calculation. McCourt notes that global mobile computing revenue rose 34% with Apple’s results included, but sagged 0.4% in the fourth quarter when Apple is taken out of the picture.
Analyst: an 'iTV' could nab 5% of the HDTV market
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Barclays Capital analyst Ben A. Reitzes says that an Apple-branded HDTV (the rumored "iTV") would bring in US$17 billion in revenue and garner 5% of the HDTV market.
Reitzes thinks the LCD market will reach about 230 million units in 2012. The forementioned $17 billion in revenue would be almost 10% of his fiscal 2013 estimate of $183.1 billion for Apple.
With assumed gross margins of around 40% on a full-fledged Apple television set, he sees the company gaining about $5.40 earnings per share, or about 11% of his fiscal 2013 earnings per share of $48.46. Reitzes thinks that an iTV could eventually become more than "just" a TV -- including gaming, video, communication, content delivery, apps, computing and all the capabilities of the current Apple TV.
Siri accounts for a quarter of Wolfram Alpha queries
Apple's Siri voice technology accounts for about one-fourth of the queries fueled by the Wolfram Alpha search engine (http://www.wolframalpha.com/), according to "The New York Times" (http://macte.ch/8Li5U).
According to Apple, Siri isn’t like traditional voice recognition software that requires you to remember keywords and speak specific commands. Siri understands your natural speech, and it asks you questions if it needs more information to complete a task.

Smart Audio Tech sues Apple for patent infringement
Another day, another lawsuit. A Texas "shell company," Smart Audio Technologies, has filed a suit claiming Apple’s iPod nano and other devices violate its patent for random song playlists, reports "Mashable" (http://macte.ch/no0Ik).
"While these type of 'patent troll' lawsuits are filed everyday against Apple and other technology companies, this one is notable because Smart Technologies is represented by a new law firm founded by Joseph Farnan Jr., a former federal judge who worked in the same Delaware court where the lawsuit was filed," the article adds.
The suit comesmsix months after a jury found Apple violated the playlist patent of another Texas entity, Personal Audio, and ordered the tech giant to pay US$8 million. Apple is appealing that decision.

Apple bucks declining computer trend in the UK, France
Computer shipments in Western Europe totaled 16.3 million units in the fourth quarter of 2011, a 16% decline from the equivalent period in 2010, according to Gartner (http://www.gartner.com). Apple was one of the few companies that, overall, bucked the trend.
For the year, computer shipments numbered 58.5 million units in Western Europe in 2011, also a 165 decrease from 2010. The computer market in Western Europe has suffered four consecutive quarters of shipment decline.
"Despite aggressive pricing and special holiday deals for PCs, consumers' attention was caught by other devices, such as smartphones, media tablets and e-readers," says Meike Escherich, principal analyst at Gartner. "Even though we saw a drop in prices, consumer coomputer shipments could not match the levels of previous years."

Apple and Walmart subsidiary Sam’s Club are in early discussions to widen their already existing partnership, according to "9to5 Mac" (http://www.9to5mac.com).
Sam’s Club currently sells Apple’s iPhone, iPad, and iPod lines within its large retail chain. However, the compamy and Apple are looking to expand the relationship, the article adds. In New Zealand Apple is fighting a trademark application for a smartphone case dubbed the "driPhone" (http://www.driphone.co.nz/), reports the "Sydney Morning Herald" (http://macte.ch/3gwQN).
Hayden Crowther, of Hamilton, New Zealand created the driPhone as a waterproof case for smartphones of all varieties but Apple is opposing his plans to trademark it in New Zealand and has now asked him to switch the "i" in driPhone for a "y," the article adds.
Apple told Crowther, through Wellington-based patent and trademark attorney firm Henry Hughes that it was opposing his driPhone trademark in New Zealand. However, the inventor thinks there's "little weight" to Apple's opposition and, so far, has refused to rebrand it.
Analyst: iPad 3 will leave competitors in the dust
In a note to investors -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Deutsche Bank analyst Chris Whitmore says he's expecting the third generation iPad next month that will sport a high-resolution display, a quad-core CPU, graphics performance four to five times faster than the iPad 2, and Siri voice control.
More juice in the iPad 3 will leave competitors further behind and drive Apple market share gains, he adds. Estimates from Deutsche Bank, combined with data from IDC, suggest that Apple currently has a 25% share of the combined notebook and tablet market.
Whitmore said none of the iPad competitors introduced in the last 12 months have come close to the iPad. He tells clients that most of the products have been "me-too" offerings with too little differentiation from each other.
Best Buy survey mentions and Apple HDTV
"The Verge" (http://macte.ch/HQ4Dk) reports that Best Buy appears to be sending surveys to customers getting feedback on potential new products and services, including the rumored Apple-branded HDTV (the "iTV").
The article says that the the product willcrun iOS, support iCloud, be controllable from an iPhone or iPad, and have access to Netflix, YouTube, and Flickr. Also, it will purportedly offer an "iSight camera" (though Apple's been calling it a FaceTime camera lately). There's no mention of Siri voice support.

Apple reportedly sued for selling the iPad in mainland China
Another day, another lawsuit. Apple is being sued by Proview Shenzhen Techonology for selling the iPad in mainland China, reports "iSmashPhone.com."

The worldwide smartphone market grew 54.7% year over year in the fourth quarter of 2011 (4Q11), as Apple unleashed its iPhone 4S on an eager marketplace, according to new data from IDC (http://www.idc.om).

Motorola wants 2.25% of Apple's sales in return for license to standard-essential wireless patents, according to a report at "FOSS Patents" (http://macte.ch/bCw0J).
"I assume this relates to Apple's sales and to all of MMI's standard-essential patents, though the context is only one patent (the one over which Motorola has already forced Apple, temporarily, to remove certain products from its German online store," Florian Mueller writes for "FOSS Patents." "Assuming in Motorola's favor that this was a license to all standard-essential wireless patents, the amount still appears excessive to me given how many companies hold patents on such standards and what royalty rate this would lead to in the aggregate."

Google has hired Simon Prakash, a senior director at Apple, for a "secret project," according to "VentureBeat" (http://macte.ch/L2A4h). The project is "presumably run by Google co-founder Sergey Brin, the article adds.

Apple, which has spent the past day pulling older models of the iPhone and iPad inventory from the shelves of its online store in Germany, is now restoring them.
Apple has pulled several iPad and iPhone models from its German online store after Motorola Mobility enforced a patent injunction against its rival, reports the "BBC" (http://macte.ch/7GmXq). Now in a statement given to "AllThingsD" (http://macte.ch/TVRgM), Apple confirmed that the iPhone 3G, iPhone 3GS, iPhone 4 and 3G/UMTS-based iPads should be returning to the shelves of its German online store in a matter of hours.
"All iPad and iPhone models will be back on sale through Apple’s online store in Germany shortly," an Apple spokeswoman told AllThingsD. "Apple appealed this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago."
Forensics firm cracks Apple's FileVault
Apple's FileVault disk encryption can be circumvented in less than an hour, according to a computer forensics firm, reports "The Register" (http://macte.ch/pGMcM). Technology from Passware can purportedly capture the content of a Mac machine's memory, via Firewire interfaces, before extracting encryption keys.
Passware claims the latest version of its toolkit (Passware Kit Forensic 11.3) can recover hashed passwords with rainbow tables and extracting passwords from encrypted Mac keychain files as well as building a password list for its dictionary attack (based on the words detected in a computer memory). It can also reportedly unlock volumes encrypted using TrueCrypt, a disk encryption software that ranks alongside PGP as the choice of privacy-conscious computer users, human rights activists and others, according to "The Register."

Apple pulls iOS devices in Germany in ongoing legal dispute
Apple has pulled several iPad and iPhone models from its German online store after Motorola Mobility enforced a patent injunction against its rival, reports the "BBC" (http://macte.ch/7GmXq).
The move follows a December ruling that Apple had failed to license one of Motorola's wireless intellectual properties. iPhone users in Germany may also face the loss of their push email iCloud service after a separate patent victory by Motorola, notes the "BBC." Apple has said it will appeal.
This is part of an ongoing battle. Earlier this month the U.S. International Trade Commission (ITC) ruled that Motorola's Droid smartphones don't violate three Apple patents. The ruling is preliminary and needs to be approved by the ITC's full six-member commission.

Australia: Apple widens its legal claims against Samsung
Apple has widened its claims against Samsung in its ongoing patent battle with the company it was revealed in the NSW Federal Court in Australia, reports "The Australian IT" (http://macte.ch/0XsKN).
Samsung lead barrister Neil Young SC said Apple had "enormously" expanded its patent bid which initially involved three patents of features in the Korean company's Galaxy Tab 10.1, the article adds. The lawsuit now encompasses 278 claims across 22 patents that cover 10 Samsung devices.
Avid releases video editing app for the iPad
Avid has released its first video editing application for the iPad -- Avid Studio, available immediately at the Apple App Store. The company says it's the first iPad app for video editing to offer frame-by-frame editing accuracy and access to all kinds of media.
As a special launch promotion, Avid Studio for iPad is being offered for US$4.99.
It allows users to begin editing by offering access to any videos, photos and audio already in their iPad library, or media that can be imported from iTunes, cameras and more. Users can then arrange clips in the Storyboard, make edits using the Timeline, and enhance their movie creations with transitions, effects and a soundtrack.

Apple has 12.4% of mobile subscribers, 29.6% of smartphone market
comScore (http://www.comscore.com), which "measures the digital world," released data from the comScore MobiLens service, reporting key trends in the U.S. mobile phone industry during the three month average period ending December 2011.
The study surveyed more than 30,000 U.S. mobile subscribers and found Samsung to be the top handset manufacturer overall with 25.3% market share. Google Android strengthened its lead in the smartphone market to reach 47.3 percent market share.
For the three-month average period ending in December, 234 million Americans age 13 and older used mobile devices. Device manufacturer Samsung ranked as the top OEM [original equipment manufacturer] with 25.3% of U.S. mobile subscribers, followed by LG with 20 % share and Motorola with 13.3% share. Apple continued to gain ground in the OEM market with 12.4% share of total mobile subscribers (up 2.2 percentage points), while RIM rounded out the top five with 6.7% share.

Cook talks of Apple's charitable efforts
In a "town hall" meeting at Apple's Cupertino, California, campus last week, CEO Tim Cook talked about Apple's charitable contributions, notes "The Verge" (http://macte.ch/86W1x).
Cook said that Apple has donated a total of US$50 million to Stanford's hospitals, split into $25 million for a new main building and $25 million for a new children's hospital. The CEO also spent "quite a bit of time" talking about Apple's status as the leading contributor to Project RED, to which Apple has given over $50 million.

Judge to Apple, Motorola: trim those patent claims
This week Circuit Judge Posner, who is serving by designation on the United States District Court for the Northern District of Illinois to preside over an Apple v. Motorola Mobility lawsuit, entered an order that, among other things, tells the parties to trim the number of patents in play, reports "FOSS Patents" (http://macte.ch/LSVJ2).
The order acknowledges that Apple and Motorola made a January 30 submission that complied with a request to inform the court "of what patents they wish to litigate in the liability trial," but "not fully satisfactorily" to Posner. The judge wants more "winnowing" to take place, notes "FOSS Patents."
Originally, there were 15 Apple and six Motorola patents at issue. The judge threw out some of those claims on summary judgment, and the parties dropped others in order to be cooperative and to narrow the case, reports "FOSS Patents."

Apple continues to lead Dell and HP in customer service quality for phone-based technical support, but Apple’s support satisfaction among surveyed customers dropped significantly over the past 18 months, according to the latest study conducted by Vocallabs (Vocalabs).
In telephone interviews immediately following a support call, 54% of Apple customers were "Very Satisfied" with the experience during the last six months of 2011, compared to 44% of Dell customers and 49% of HP customers. Apple’s satisfaction score is down 19 points from the first half of 2010, while Dell and HP have generally held steady over the past two years.
Looking at common complaints in 2011, less than 1% of Apple customers surveyed complained about the language skills of the support technician; much fewer than the 8% of Dell customers and 10% of HP customers with similar issues. Many customers also complained about the extra cost of out-of-warranty tech support, but Apple saw fewer complaints here, too. About 1...

Xbox Live marketing boss Robin Burrowes is the latest games exec to join Apple, notes "MCV" (http://macte.ch/5GPWC).
Burrowes worked at Microsoft for seven years, and was in charge of Xbox Live. Prior to that, he worked for MSN and HMV.

IDC: Apple number three in global mobile phone market
The worldwide mobile phone market grew 6.1% year over year in the fourth quarter of 2011 (4Q11), as the feature phone market declined faster than anticipated, dragging market growth down to its lowest point in over two years.
According to the IDC research group (http://www.idc.com), vendors shipped 427.4 million units in 4Q11 compared to 402.8 million units in the fourth quarter of 2010. The 6.1% year-over-year growth was higher than IDC's forecast of 4.4% for the quarter, but weaker than the 9.3% growth in 3Q11.
IDC says Apple jumped into the third spot globally from the fifth spot last quarter thanks to a record-breaking quarter of shipments. That represents the Cupertino-based company's highest-ever ranking on IDC's top 5 global mobile phone leaderboard.

Holiday tablet traffic jumps 229%
If you didn’t get a tablet this holiday season, you may be one of the few. According to Jumptap (http://www.jumptap.com), which specializes in targeted mobile advertising, tablet network traffic jumped 229% over an average projected for the day after Christmas, based on historical network traffic.
Jan. 2, 2012 also saw a bump, with a 263 percentage traffic increase -- most likely from recipients uploading holiday photos and getting familiar with their devices. In its newly released "January MobileSTAT" report, Jumptap found that the Kindle Fire experienced the greatest tablet growth throughout December. Apple releases Mac OS X 10.7.3
Apple has released Mac OS X 10.7.3. You can obtain the update via the Software Preferences component of the Mac OS X Systems Preferences app.
According to Apple, Mac OS X 10.7.3 addresses stability, compatibility, and security issues. The upgrade includes Safari 5.1.3 and adds support for more languages, including Catalan, Croatian, Greek, Hebrew, Romanian, Slovak, Thai, and Ukrainian.

Neil Young: Jobs wanted more hi-def music available from Apple
Musician/singer/songwriter Neil Young says the late Steve Jobs was interested in seeing Apple offer hi-def music options, according to "CNN Tech." However, that seems to be on hold following Jobs' death.
In an onstage interview at News Corp.'s D: Dive Into Media conference Tuesday. Young says Apple consulted with him and others in the music industry regarding a project to develop electronics and distribution channels for high-definition music.
Last year "CNN" reported a year ago that Apple, along with other digital music retailers, were talking with executives in the record industry about selling high-fidelity tracks in iTunes and retooling iPods to be compatible with them.

German court refuses to ban tweaked Galaxy Tab
A German court has refused Apple’s request to ban Samsung’s altered Galaxy Tab 10.1N, reasoning that the tablet had been altered enough to skirt Germany’s unfair competition law, according to "Bloomberg" (http://macte.ch/QKwZV).
“Samsung has shown that it is more likely than not that the patent will be revoked because of a technology that was already on the market before the intellectual property had been filed for protection,” said Munich Regional Court Judge Andreas Mueller.
The decision comes a day after a Dusseldorf appeals court upheld Apple’s request to ban sales of the Galaxy Tab 10.1, the predecessor model. Samsung began selling the Galaxy Tab 10.1N, a revised version, in Germany to get around the ban, notes "Bloomberg."
A lower Dusseldorf court is scheduled to rule next week on a separate case Apple filed over the Galaxy 10.1N, the article adds. In January Samsung lost two patent rulings against Apple in a Mannheim court.
China Telecom to purportedly get the iPhone 4S this month
China Telecom will star selling the iPhone 4S by the end of this month or early March, according to the "China Daily," as reported by "paidContent.org" (http://macte.ch/LtIDS).
The move to add China Telecom as a carrier partner will also make a big difference to Apple’s exposure in the country, the article notes. Citing figures from the Gartner research group, "China Daily" says Apple is currently the fourth-largest smartphone vendor in the country, trailing Nokia, Samsung and Huawei.
NetMarketShare: Mac OS X shares up, Safari, iOS down slightly
According to the latest market share survey from NetMarketShare (http://www.netmarketshare.com), the market share for Mac OS X, Safari and iOS all rose last month.
According to the report, among desktop operating systems, Mac OS X had 6.39% of the global market share in January compared to 6.36% in February (that's global market share; in the US it's over 10%). Windows remains dominant with 92.05% as of January. That's down from 92.23% in December.According to NetMarketShare, Mac OS X 10.6 ("Snow Leopard") accounted for 2.95% of Apple's share and Mac OS X 10.7 ("Lion") 2.02%. That comes to 3.05% and 2.18%, respectively, for December.
When it comes to browsers, Safari had 4.90% in January. Internet Explorer had 52.96%, Firefox had 20.88% and Chrome had 18.94%. That compares to, respectively, December percentages of 4.97%, 51.87%, 21.83% and 19.11%, respectively, for the browsers.

Analyst: Apple looking into purchasing TV display components
In a note to investors -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Piper Jaffary analyst Gene Munster says Apple has contacted at least one major Asian supplier about purchasing television display components.
Quoting an unnamed "major TV component supplier," he says this is "continued evidence that Apple is exploring production of a television." Apple could be ready to release a television as early as late 2012, though Munster noted that "the timeline and stope of a revamped content solution is more uncertain." Those who believe that an "iTV" is in the works feel that Apple has hit major resistance from movie and TV studios about licensing their content to Apple.
In addressing the issue, Munster says that Apple could:
° Simply enable the television to manage pre-existing live TV service from a unified interface;
° Make use of network programming and web-based video services such as Netflix and Hulu;

U.S. Government says iPhone jailbreaking is okay
The United States Government, at the request of the Electronic Frontier Foundation, has announced "what amounts to a blanket exemption to the controversial Digital Millennium Copyright Act (DCMA) for activities that all under the Fair Use doctrine of U.S. Copyright law," reports the "CIO" web site (http://macte.ch/0aFfD).
This announcement, and change in DCMA enforcement policy, has wide-ranging implications for consumers of electronic devices and media, the article adds. As it applies to the on-going battle between Apple and iPhone hackers, the new rules stipulate that Apple may not actively prevent attempts to "jailbreak" the iPhone to allow extra functionality with either hardware or software measures," says "CIO."
Jailbreaking refers to the process of removing the limitations imposed by Apple on iOS. Jailbreaking allows users to access the operating system, download additional applications, extensions, and themes that are unavailable through the official Apple App Store.

Foxconn to build five new factories in Brazil
Foxconn, which manufacturers various products for Apple, plans to build five additional factories in Brazil to help meet demand for Apple products, which are expected to combine for an annual run rate of nearly 400 million units within five years, reports "AppleInsider" (http://www.appleinsider.com)
São Paulo's Secretary of Planning and Development of the State, Julio Semeghini, said the five factories, which are in addition to the one already believed to be turning out iPads and iPhones, will each staff roughly 1000 workers. AirPort Base Station and Time Capsule Firmware Update 7.6.1 is for all 802.11n AirPort Express, 802.11n AirPort Extreme and Time Capsule models. It fixes an issue with wireless performance and provides support for remote access to an AirPort disk or a Time Capsule hard drive with an iCloud account.

Consumer Group calls on Apple to stop worker abuse
Apple is the target of a new online grassroots campaign, as consumer accountability group SumOfUs has launched a new campaign calling on Apple to address dangerous conditions in factories manufacturing its products.
Last week, the "New YorkTimes" reported on abysmal conditions in Apple’s factories in China, including excessive overtime, poor living conditions, exposure to toxic chemicals, and violations of child labor standards. In response, SumOfUs launched a new petition yesterday, calling on members to urge Apple to address the concerns, with more than 35,000 people signing on within the first 24 hours.

John Browett is Apple's new senior vice president of retail
Apple says John Browett will join the company as senior vice president of Retail, reporting to Apple CEO Tim Cook.
Browett comes to Apple from European technology retailer Dixons Retail, where he has been CEO since 2007. Beginning in April, he will be responsible for Apple’s retail strategy and the continued expansion of Apple retail stores around the world.
"Our retail stores are all about customer service, and John shares that commitment like no one else we’ve met," says Cook. "We are thrilled to have him join our team and bring his incredible retail experience to Apple."
Prior to joining Dixons Retail, Browett held a series of executive positions at Tesco plc including CEO of Tesco.com.
